Rooms-To-Go furniture store sued for alleged breach of contract

NEW ORLEANS – An New Orleans couple has brought a suit against a local furniture store claiming it failed to honor a warranty.

Wayne M. Babovich and Charlene F. Babovich filed a lawsuit against Rooms-To-Go Louisiana Corporation and Rooms-To-Go St. Tammany LLC in the Orleans Parish Central District Court on Dec. 10. The plaintiffs claim that the defendants' failure to repair protruding nails, tears and holes in the sofa fabric and a collapsed bed frame, all purchased and under warranty through the defendant, resulted in breach of contract and has caused them to suffer.

The defendant is accused of breach of contract, failure to know of the defects in products prior to the plaintiffs purchase and refusal to cure the defects.

The plaintiffs are seeking the $2,204.69 paid for the furniture aforementioned and recompenses in the excess of $5,000 for each plaintiff for mental anguish and emotional distress.

Babovich will represent himself and his wife in court as a partner with the New Orleans, LA-based law firm Babovich & Spedale PLC.

This case has been assigned to Division D Judge Lloyd J. Medley.
