Winn-Dixie sued over carjacking and assault

NEW ORLEANS – A New Orleans woman is suing Winn-Dixie after allegedly being attacked and robbed at a local store.

Marilyn Evans filed a lawsuit against Winn-Dixie Montgomery LLC in the Orleans Parish Central District Court.

Evans claims that while leaving the defendant's Chef Mentuer Highway store, she was beaten and her car was stolen by two unknown assailants resulting in severe personal injuries to her head, neck and back.

The defendant is accused of failing to protect customers knowing that criminal acts had been perpetrated on the premises in the past and allowing predators to stalk prey outside the business.

An unspecified amount is sought for all damages including all medical bills, physical pain and mental pain.

The plaintiff is represented by New Orleans-based attorney Sean P. Early.

This case has been assigned to Division F Judge Christopher J. Bruno.

Case no. 2012-11681.
