Marrero Wendy's sued by woman claiming disability after falling in bathroom hallway

GRETNA –  A Jefferson Parish woman is suing a local fast food chain restaurant for injuries she claims to have received in a fall on its premises.

Gaynell Bladsacker filed suit against ACE American Insurance, the Wendy's Company, Wendy's International Inc., Eddie M. Charles and Kyle J. Ponseti III  in the 24th Judicial District Court on Jan. 11.

Bladsacker claims she was at the Wendy's located at 7021 Westbank Expressway in Marrero when she slipped and fell in the bathroom hallway. The plaintiff alleges she suffered severe and disabling injuries in the fall, especially to her left hip.

The defendant is accused of failing to use reasonable care to keep passageways and floors in a clean and safe condition, failing to use reasonable care to keep premises free of hazards, failing to properly inspect the premises, failing to establish proper procedures for cleaning and inspection, creating a risk, allowing a dangerous substance to remain on the hallway floor and having constructive notice of the condition that caused the plaintiff's injury.

An unspecified amount of damages is sought for pain, disability, mental suffering, medical expenses, loss of wages and impairment of earnings capacity.

Bladsacker is represented by Seth H. Schaumberg of Favret, Demarest, Russo & Lutkewitte.

The case has been assigned to Division C Judge June Berry Darensburg.
