NEW ORLEANS – A New Orleans woman is suing the local branch of Entergy and a Tchoupitoulas Street restaurant after she allegedly tripped and fell due to the corporation’s negligence.
Susan E. Ogden, wife of/and Warren J. Greenwood Jr. filed a lawsuit against Entergy New Orleans Inc., Bellsouth Telecommunications LLC, Bellsouth Communication Systems LLC and Vandelay Restaurant Group LLC in the Orleans Parish Central District Court on Jan. 11.
Ogden claims that while leaving Dick and Jenny’s restaurant, the left heel of her shoe got caught on an unprotected and unmarked pylon/utility pole guy wire stake owned by defendants, causing her to fall and land on her right knee. Ogden allegedly suffered a tibial plateau fracture as a result of the fall.
The defendants are accused of failing to correct a dangerous and defective condition, failing to warn patrons of the dangerous condition and failing to exercise reasonable care.
An unspecified amount is sought for pain and suffering, mental anguish, loss of life’s pleasures, medical expenses, loss of income and loss of earning capacity. The suit does not that the damages are expected to exceed $50,000.
The petitioner is an attorney and will represent herself in this matter.
