Subcontractor sues over alleged non-payment for work done on home elevation and renovation

GRETNA – A Picayune, Miss. based subcontractor is suing a Memphis-based construction firm and the owners of a household claiming it was not paid for elevation and renovations.

Oak Construction LLC filed suit against Ana B. Reyes, Manuel A. Reyes and Nelson Inc. in the 24th Judicial District Court on Jan. 25.

Oak Construction claims it entered into an agreement as a subcontractor to Nelson Inc. to raise and renovate the Reyes' household in Kenner at a cost of $88,000. The plaintiff alleges that although it completed the work under the contract it has only received $48,000 thus far. Oak Construction asserts it has served a lien for labor and materials on the defendants.

The defendant are accused of breach of contract.

Damages are sought for payment on the open account and attorney's fees of $5,000.

Oak Construction is represented by New Orleans-based attorney Gloria Lastra.

The case has been assigned to Division I Judge Nancy A. Miller.

Case no. 723-312.
