Winn-Dixie sued by woman who claims she slipped and fell on puddle of oil

GRETNA – A Jefferson Parish woman is suing a Belle Chasse grocery store for injuries she claims to have received in a fall.

Karen Hansberry filed suit against the Hanover Insurance Company, Winn-Dixie Louisiana Inc. and Victory Gretna LLC in the 24th Judicial District Court on Jan. 30.

Hansberry claims she was in the parking lot at the Winn-Dixie located at 2112 Belle Chasse Highway in Belle Chasse when she stepped in a puddle of oil and fell to the ground. The plaintiff alleges she received injuries in the fall to her back, left wrist, left palm, left arm, left shoulder and right hand. Hansberry also claims there were no signs in the proximity warning of the danger.

The defendant is accused of failing to adequately warn the plaintiff of a dangerous situation, failing to timely and appropriately clean up the oily substance, failing to properly warn the plaintiff by placing signs or barricades in the area, failing to adequately inspect the premises, failing to maintain the premises in a reasonably safe condition, failing to adequately oversee persons responsible for maintaining the condition of the parking lot and failing to meet the standard of care required.

An unspecified amount in damages is sought for medical expenses, physical pain and suffering, mental pain and suffering, emotional pain and suffering, loss of enjoyment of life, lost earnings, loss of earning capacity, loss of use, permanent physical disability, inconvenience, expenses, statutory and legal interest, court costs and attorney’s fees.

Hansberry is represented by David J. Mitchell of the New Orleans-based the Law Office of Frank D’Amico Jr.

The case has been assigned to Division O Judge Ross P. LaDart.
