NEW ORLEANS – A local fine wine distributor is suing a North Carolina-based competitor for alleged damages.
Purveyor of Fine Wines LTD filed a lawsuit against European Cellars LLC in the Orleans Parish Central District Court on Feb. 6.
The plaintiff claims that the defendant’s termination of their wine distribution agreement was in blatant violation of state law requiring that an agreement without a specified duration be terminated by the giving of reasonable notice sufficient to allow the other party to alter its affairs accordingly. Plaintiffs claim to have suffered damage to their businesses reputation and loss of profit as a result of the contract annulment. The suit states the plaintiffs were warned only one month prior to the scheduled termination.
The defendant is accused of breach of contract, failure to give reasonable notice of termination of a contract without stated duration, bad faith, negligent misrepresentation and violating Louisiana’s Unfair Trade Practices Act.
An unspecified amount is sought for all damages found reasonable in the premises along with all legal costs and attorney's fees.
