GRETNA – A Gretna couple is suing their landlord and the City of Gretna alleging their apartment was flooded with raw sewage that destroyed their belongings and caused them to have health problems.
Harvey and Cheri Randall filed suit against Morguard NAR U.S. Holdings LLC, Morguard Management Company Inc., Revenue Properties Management Company Inc., the City of Gretna and the Parish of Jefferson in the 24th Judicial District Court on Feb. 6.
The Randalls claim they entered into a lease with Morguard NAR U.S. Holdings LLC, Morguard management Company Inc. and Revenue Properties Management Company Inc. for an apartment at Garden Lane Apartments located at 401 20th St. in Gretna on April 30, 2012 and that on June 16, 2012 after returning from a two week absence they found their apartment and belongings within in it had been damaged by raw sewage. The plaintiffs allege they suffered the loss of much of their property including clothing, furniture and personal items and that they also suffered health problems related to the sewage including shortness of breath, bronchitis as well as other physical injuries.
The defendant landlords are accused of improperly installing pipes in the apartment and not monitoring them properly allowing raw sewage to come into the property, improper operation of the apartment’s sewage system and failing to take necessary action to prevent the sewage backup.
The City of Gretna and Parish of Jefferson are accused of improperly installing and maintaining pipes leading into the apartment complex, allowing raw sewage to backup in the plaintiffs’ apartment, improper operation of their sewer systems and failing to take necessary action to prevent the sewage backup.
An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering, inconvenience, anxiety, shock, worry and property damage.
