Man who allegedly received wrong medication sues Walgreens pharmacy

GRETNA – A Jefferson Parish man is suing a local outlet of a corporate drugstore for allegedly giving him the incorrect prescription.

Frank Gardner filed suit against Walgreens and Walgreens Family of Companies in the 24th Judicial District Court on Feb. 15.

Gardner claims he visited the Walgreens located at 1556 Lapalco Blvd. in Harvey was supposed to receive Clonidine to lower his blood pressure, but instead received Clonazepam which is used to treat those with seizure and panic attack disorders. The plaintiff alleges that he did not realize he had received the wrong medication and continued to take it and began to have numbness and tingling in his left hand, memory loss and high blood pressure. Gardner asserts that was injured due to receiving the incorrect medication.

The defendant is accused of failing to distribute the medication correctly to the plaintiff, failing to read the label before giving the medicine to the plaintiff, failing to use reasonable and prudent care under the circumstances, failing to properly train its employees and failing to take any and all necessary medical preventive measures.

Damages not to exceed $75,000 are sought for physical pain and suffering, mental anguish and medical expenses.

Gardner is represented by Robert J. Caluda of the Metairie-based Caluda Law Firm.

The case has been assigned to Division L Judge Donald A. Rowan Jr.

Case no. 724-023.
