Bywater supermarket sued after man trips over crates

NEW ORLEANS – A New Orleans man is suing a Bywater supermarket after tripping over crates.

Richard Farnell filed suit against Wagner’s Inc., Wagner’s Supermarket and unknown individuals in the Orleans Parish Civil District Court on March 1.

Farnell claims to be a resident of Orleans Parish although his address is listed in California. The accident occurred March 3, 2012 in Wagner’s Supermarket on St. Claude Ave.

Farnell claims he was walking down an aisle when he tripped and fell on the unattended crates and was allegedly injured.

The defendant is accused of negligence for causing an unreasonably dangerous condition to exist and for failing to correct an unreasonably dangerous condition.

An unspecified amount of damages is sought for medical expenses, pain, suffering, grief, mental anguish, medical expenses and loss of enjoyment of life.

The plaintiff is represented by Pius A. Obioha of the Law Offices of Pius Obioha & Associates. A jury trial is requested.

The case has been assigned to Division D Judge Lloyd J. Medley.
