Woman sues after shelves allegedly fall on her at Dollar General

NEW ORLEANS – A local woman claims that she was seriously injured when shelving units fell on her in a New Orleans Dollar General.

Alma Hudson filed suit against Dolgencorp (dba Dollar General) and their insurer in the Orleans Parish Civil District Court on March 5. The accident occurred while Hudson was shopping at the Dollar General on April 24, 2012. The suit alleges that a store employee witnessed the shelving units hit her. She was knocked to the ground, causing an ankle sprain, hypertension, a shoulder strain and acute stress reaction. The plaintiff is also suffering from ongoing sleeplessness.

The defendant is accused of negligence for failing to maintain a safe business environment, failing to properly fasten the shelf to its backing, failing to see what should have been seen, failing to exercise necessary caution and due care, failing to take reasonable steps to prevent the hazard that cause the injury, failing to act as a prudent and reasonable retailer, maintaining Dollar General in a careless or reckless manner and for operating a business in a dangerous environment.

An unspecified amount of damages is sought for mental anguish and emotional trauma, emotional distress, pain and suffering, loss of pursuit of happiness, loss of support, love, affection and society and medical, hospital and pharmaceutical expenses.

The plaintiff is represented by Pius A. Obioha of New Orleans-based Pius A. Obioha & Associates.

The case has been assigned to Division D Judge Lloyd J. Medley.
