Winn-Dixie sued by customer who slipped on water in front of store

GRETNA – A local grocery store is being sued by a customer who allegedly slipped on water the was used to water plants in front of the store.

Merle LeBlanc filed suit against Winn-Dixie Stores Inc. in the 24th Judicial District Court on April 3. LeBlanc claims he was shopping at the Winn-Dixie located at 40451 Williams Blvd. in Kenner when he slipped on water outside the store that was being used to water plants. The plaintiff alleges that he received serious injuries in the fall including a torn hamstring.

The defendant is accused of failing to keep its premises in a reasonably safe condition, failing to use reasonable effort to keep the premises free of hazards, failing to prevent the plaintiff from suffering harm on the property, failing to warn of the danger, failing to keep the property free of hazards, failing to properly inspect the property, failing to provide a safe environment for customers, failing to implement proper procedures to maintain a safe environment for customers, failing to implement a proper plan to inspect and remove hazards, failing to provide a hazard free environment and failing to meet requirements under federal law.

An unspecified amount in damages is sought for physical pain and suffering, discomfort, mental anguish, aggravation, annoyance, medical costs, loss of enjoyment of life, lost wages, property damage and disability.

The case has been assigned to Division P Judge Lee V. Faulkner Jr.
