General contractor sues gutter company and employee for workers' compensation fees

NEW ORLEANS – A New Orleans general contractor is suing several entities it claims are responsible under state statute for funds expended in a workers' compensation suit.

J.W. Drennan LLC filed a lawsuit against The Gutter & More Guy LLC, Chanse Mortenson and Strickland General Agency Inc. in the Orleans Parish Central District Court on March 8.

The plaintiff maintains that due to alleged negligent acts by the defendant, a J.W. Drennan employee was injured and defendants are should be held vicariously liable for damages in the form of amounts expended on the employee’s behalf in a workers' compensation suit.

The defendant is accused of negligence and strict liability.

The plaintiff is seeking full compensation for the amount of money that will be afforded to the injured employee in his workers' compensation suit and legal interest.

Attorney Michael J. Winsberg of New Orleans is counsel for the plaintiff.

This case has been assigned to Division L Judge Kern A. Reese.

Case no. 2013-02347.
