Former Clean-Up Worker Alleges Negligence Against BP Over Health Issues

In a dramatic legal move, a former clean-up worker from the BP Deepwater Horizon Oil Spill has filed a lawsuit against BP Exploration & Production, Inc. and BP America Production Company. The complaint was lodged by Michael Steven Smith in the United States District Court for the Eastern District of Louisiana on April 18, 2025. Smith accuses BP of gross negligence and willful misconduct during the oil spill cleanup operations that allegedly led to his serious health issues.

Michael Steven Smith, who resides in Marrero, Louisiana, worked as a clean-up worker from May to November 2010 as part of the Vessel of Opportunity program during the aftermath of the Deepwater Horizon Oil Spill. According to Smith's complaint, he was exposed to numerous toxic chemicals while performing his duties without adequate protective gear or safety training. "BP failed to warn Clean-Up Workers of the risks... failed to provide adequate respirators and protective gear," states the complaint. The plaintiff alleges that BP's actions were not only negligent but also constituted willful misconduct in downplaying the severity of the spill and failing to provide timely warnings about its dangers.

Smith's case hinges on accusations that BP knowingly exposed workers like him to hazardous substances such as benzene and volatile organic compounds (VOCs) present in crude oil and dispersants like COREXIT used during cleanup efforts. The complaint highlights how these chemicals can cause severe health conditions, including cancer. Smith was diagnosed with B-Cell Lymphoma in August 2021, which he attributes directly to his exposure during cleanup operations.

The lawsuit seeks compensatory damages exceeding $75,000 for medical expenses, lost wages, physical pain and suffering, mental anguish, and other related costs. Additionally, Smith requests punitive damages due to BP's alleged reckless disregard for human safety. He also demands a jury trial to resolve these claims.
