BATON ROUGE – A patron of a local fast food restaurant located in a local outlet of an international retailer is suing both entities after allegedly falling and sustaining injuries on the premises.
Billy Floyd filed a lawsuit against Valluzzo Companies LLC, McDonald’s, Arch Specialty Insurance Company, Wal-Mart Louisiana LLC and Wal-Mart Stores Inc. in the 19th Judicial District Court.
Floyd claims that while attempting to exit the McDonald’s within the Wal-Mart at Cortana he slipped and fell on the wet floor injuring his right knee and leg as well as his back.
The defendant is accused of placing a wet substance on the floor, failing to properly secure the area where the dangerous condition was present, failing to keep the premises hazard free and failing to warn of the potential unsafe condition.
An unspecified amount is sought for physical pain and suffering, mental distress, medical expenses, lost wages and loss of enjoyment of life.
The plaintiff is represented by Scott M. Emonet of Baton Rouge-based Murphy Law Firm.
This case has been assigned to Section 23 Judge William A. Morvant.
