Remodeling company sued for allegedly breaching oral contract for home renovation

GRETNA – A Jefferson Parish couple is suing the company that was to provide a renovation on their home after the company allegedly took payment for the job, but did not complete the work.

Anthony and Leonor Fuentes filed suit against Nortberto’s Remodeling, Reynaldo Sarasino and Nortberto Sarasino in the 24th Judicial District Court on May 28.

The Fuentes claim they entered into an oral contract to and paid $2,000 to Nortberto’s Remodeling and the Sarasinos to provide home renovation services on their home before any work was done. The plaintiffs further allege that in December 2012 Anthony Fuentes provided a $500 loan to Nortberto Sarasino and in February 2012 Leonor Fuentes loaned Reynaldo Sarasino $500 for which the defendants gave them a post-dated check in the amount for $1,000. However, the plaintiff asserts the check was later rejected when they tried to cash it.

The defendant is accused of breach of contract, not providing services for payment and defaulting on their loan.

Damages in the amount of $1,000 in personal loans, $2,000 in construction work payments that were never done, reasonable attorney’s fees, non-compliance with Louisiana Unfair Trade Practices Act and legal costs are sought by the plaintiffs.

The plaintiffs are represented by Patrick B. Sanders of Metairie-based Law Office of John W. Redmann LLC.

The case has been assigned to Division L Judge Donald A. Rowan.
