Numerous businesses sued by woman who alleges she fell in hole at shopping center

NEW ORLEANS – A woman who was allegedly injured after falling into a hole at a New Orleans strip mall is suing the landlord of the shopping center as well as its tenants for injuries she claims to have received in the incident.

Verti M. Biblo filed suit against Washington Square LLC, Rod Noles Property Management Inc., Community HealthWorx, Dollar General Corporation, RDK Inc (doing business as Kyle’s Collision Center), Professional Service Industries Inc., Ratcliff Investments LLC, America First Insurance Inc., a Liberty Mutual Group Company and Gregg Thompson in the Orleans Parish Central District Court on June 13 after claiming to have suffered a fall on her way to a medical appointment. Biblo claims that when she entered the strip mall property she fell into a hole that she alleges that was created prior to her entrance as a direct result from soil testing performed on the property.  The plaintiff claims to have suffered serious and debilitating injuries in the incident.

The defendants are accused of creating a dangerous condition, failing to properly maintain its premises and failing to correct or repair the defect on the premise after having actual or contraction knowledge of the run vice and defect.

An unspecified amount in damages is sought for all injuries caused, medical expenses, pain and suffering and attorney's fees.

Biblo is represented by attorney D. Patrick Daniel Jr. of Lafayette.

The case has been assigned to Division F Judge Christopher J Bruno.

Case no. 2013-05300.
