GRETNA – A daycare center is suing its former architect for allegedly delaying the opening of a facility and requiring another firm to take over the construction, which resulted in added expenses.
Providence Pediatric Medical Daycare Inc. filed suit against AGL Architecture & Interior Design and Brian E. Anderson in the 24th Judicial District Court on May 31.
Providence Pediatric Medical Daycare Inc. claims it made plans to open a daycare facility for children with special needs at 3001 Division St. in Metairie. The plaintiff alleges that it contracted with AGL Architecture & Interior Design and Brian E. Anderson failed to provide architectural and design services to renovate the ground floor of a commercial office building.
Providence Pediatric Medical Daycare Inc. asserts that the defendants failed to fulfill the contractual requirements that resulted in delay and added expenses to the renovation. The plaintiff asserts that it canceled the contract with the defendant and that AGL Architecture & Interior Design agreed to help transition to a new architect, which resulted in additional issues and problems.
The defendant is accused of breach of contract for not fulfilling the contract in a timely manner, failing to obtain necessary engineers and not obtaining the necessary permits.
An unspecified amount in damages is sought for additional costs to retain other architectural services to complete the job, additional expenses to renovate and to obtain the necessary permitting and renovations and lost revenue due to the delay in the opening of the facility.
