Law professor sues grocery store after slip and fall incident

NEW ORLEANS - A Southern University Law Center professor has filed a personal injury lawsuit against a Metairie grocery store claiming the store’s negligence resulted in a slip and fall accident.

Steve V. Barbre filed suit against Winn-Dixie Montgomery and ABC Insurance Co. on Aug. 1 in Jefferson Parish District Court. The defendants removed the case to federal court in New Orleans on Aug. 19.

The alleged incident occurred on Aug. 5, 2012 as Barbre was shopping at the Winn-Dixie Montgomery in Metairie. While walking near the register lines, he slipped on some pooled liquid and lost his balance and slid on the floor. Barbre fell awkwardly and severely injured his right knee.

According to the lawsuit, the store manager responded to the incident and noticed the liquid on the ground. Barbre was transported to the hospital via ambulance.

The defendants are accused of negligence for failure to properly train or supervise employees in clean- up operations and policies and responding to an on-site injury, failure to properly monitor store for dangerous conditions, failure to assign adequate staffing to safely meet the operational needs of the store, failure to warn of dangerous conditions caused by liquids pooled on the floor, failure to timely clean spilled liquids and failure to timely correct the dangerous condition having knowledge of its existence.

The plaintiff is asking for an award of damages and interest.

Barbre is represented by Herbert Cade and Aaron Ahlquist of Herman, Herman & Katz in New Orleans.

U.S. District Judge Sarah S. Vance is assigned to the case.
