NEW ORLEANS - A former Xavier University counselor has filed a lawsuit against she was fired for taking intermittent medical leave to take care of her mother.
Terri Torregano filed suit against Xavier University of Louisiana in Orleans Parish District Court. The defendant removed the case to federal court in New Orleans on Aug. 7.
Torregano began her employment with the defendant in 2003 as an outreach counselor. In September 2012, she requested intermittent leave to attend her elderly mother, who was recovering from a broken hip. Her request was approved, but she was terminated on Nov. 27, 2012 allegedly due to Xavier’s financial challenges. According to the lawsuit, the defendant retained all other employees on the counseling and wellness staff.
The defendant is accused of violating the Family and Medical Leave Act and Louisiana Wage laws.
The plaintiff is seeking an award of damages for wages, salary, employment benefits, interest, liquidated damages, attorney’s fees, and court costs.
Torregano is represented by Nancy Picard of Robein, Urann, Spencer, Picard & Cangemi in Metairie. A jury trial is requested.
U.S. District Judge Sarah S. Vance is assigned to the case.
