Class action lawsuit claims debt collector violated federal law with form collection letter

NEW ORLEANS - A proposed class action lawsuit claims a debt collector violated federal law by sending out a form collection letter to consumers.

Violette C. Ikonomidis filed suit against Source Receivables Management on Aug. 9 in federal court in New Orleans.

According to the lawsuit, the defendant mailed out a form collection letter to the plaintiff in an attempt to collect a consumer debt. The defendant allegedly sent a collection that stated, “If you request of this office within 30 days after receiving this notice, this office will provide you with the name and address of the original creditor, if different form the current creditor.”

The defendant is accused of violating federal law by demanding payment within 30 days.

The lawsuit is filed on behalf of the individuals who received the collection letter.

The lawsuit is seeking an award of actual damages, statutory damages, disgorgement of profits, attorney’s fees, and court costs.

The plaintiff is represented by Keren E. Gesund of The Bourassa Law Group in New Orleans. A jury trial is requested.

U.S. District Judge Helen G. Berrigan is assigned to the case.
