Seaman sues after falling out of bunk bed

NEW ORLEANS - A seaman has filed a lawsuit against his employer claiming he suffered injuries to his knee when he fell out of his bunk bed, which was missing certain bed rails.

Ambrosio O. Calleja filed suit against Aramark Corp., and Transocean Offshore Deepwater Drilling Inc. on Aug. 28 in federal court in New Orleans.

Calleja was injured while working aboard the GSF Development Driller 1 when he fell out of a bunk bed aboard the vessel. According to the lawsuit, the bed had been serviced by Aramark, which had removed certain rails. Calleja suffered injuries to his knee in the incident.

The defendants are accused of negligence for failing to provide a reasonably safe place to work, failing to properly train and supervise Calleja, failing to take any means or precautions for the safety of Calleja, creations and maintenance of an unseaworthy vessel, failing to provide minimum safety requirements, and for failing to provide adequate equipment and personnel for the job.

The plaintiff is seeking an award of damages for physical, mental and emotional pain and suffering, loss of wages, wage earning capacity, physical disability, medical expenses, interest, and court costs.

Calleja is represented by Timothy J. Young, Philip R. Adams Jr. and Tammy D. Harris of The Young Firm in New Orleans.  A jury trial is requested.

U.S. District Judge Stanwood R. Duval Jr. is assigned to the case.
