Woman sues Winn-Dixie after rogue shopping cart allegedly rolls into her vehicle

NEW ORLEANS – A local Winn-Dixie grocery store is being sued after a woman driving on the Westbank Expressway in Jefferson Parish was hit by a rolling shopping cart.

Adeline James filed suit against Winn-Dixie Montgomery LLC in the Civil District Court on August 1.

The plaintiff alleges that in January 2011, she was driving in the 1000 block of the Westbank Expressway when a Winn-Dixie shopping cart rolled from the supermarket’s parking lot and into the right lane of the road in which the plaintiff was traveling, causing her to violently strike the shopping cart.

As a result of this incident, the plaintiff claims she incurred injuries to her neck, back, body as a whole and has suffered from headaches.

The defendant is accused of negligenc and failing to implement the appropriate procedures to keep the shopping carts on its property.

The plaintiff seeks damages not to exceed $25,000 for property damage, pain and suffering, medical expenses, mental anguish and anxiety.

The plaintiff is represented by Dean J. Favret of Favret, Demarest, Russo & Lutkewitte.

The case has been assigned to Division A Judge Tiffany G. Chase.
