GRETNA – A public transit organization is being sued by a bus rider who was allegedly injured when a bus took off when she was still standing and she fell to the floor.
Ella Kendrick filed suit against Parish of Jefferson through the Department of Transit Administration in the 24th Judicial District Court on Aug. 26.
Kendrick claims on Oct. 1, 2012 she was entering a Jefferson Parish Transit bus and asked the driver to wait until she could get her fare out of her purse before taking off. The plaintiff alleges the driver did not wait and started driving the bus while she was still standing, causing her to fall to the floor. Kendrick asserts she was injured in the incident.
The defendant is accused of negligence.
An unspecified amount in damages is sought for mental pain and suffering, physical pain and suffering, medical expenses, loss of wages, loss of earning capacity, permanent and residual injury and loss of life’s pleasures.
Kendrick is represented by John B. Fox of New Orleans-based John B. Fox & Associates LLC.
The case has been assigned to Division M Judge Henry G. Sullivan Jr.
