Car dealership sues woman who allegedly stopped payment on check

GRETNA – A Jefferson Parish car dealership is suing a woman who allegedly placed a stop payment on a check she provided them for repairs they made on her car.

Harvey GM LLC and Don Bohn Buick GMC filed suit against Rochelle S. Johnson in the 24th Judicial District Court on Aug. 29.

Harvey GM LLC and Don Bohn Buick GMC claims that in October 2012 Johnson brought her car to their business because the engine overheated. The plaintiff alleges that the cost of the repairs was $1,155.59 and she made a payment in a check in the amount of $355.59, but then placed a stop payment of the check. Harvey GM LLC and Don Bohn Buick GMC assert they sent demand letters to Johnson for payment for the repairs, but she has not responded.

The defendant is accused of breach of contract.

Damages in the amount of $1,415.80 plus attorney’s fees are sought by the plaintiff.

Harvey GM LLC and Don Bohn Buick GMC are represented by Donna Bramlett of New Orleans-based McCranie, Sistrunk, Anzelmo, Hardy, McDaniel and Welch LLC.

The case has been assigned to Division F Judge Michael P. Mentz.
