GRETNA – A man and his wife are suing a local fast food restaurant after he allegedly broke his tooth when biting into a bone in a “boneless” chicken tender.
George and Trista Bailey filed suit against Cajun Operating Company, Church’s Chicken and Liberty Mutual Insurance Company in the 24th Judicial District Court on Sept. 6.
The Baileys claims that on Sept. 7, 2012 Trista was a customer at Church’s Chicken on 3740 Airline Drive in Metairie where she purchased two orders of 20-piece boneless chicken tenders. The plaintiffs allege George bit into a piece of chicken and his tooth was fractured after it hit a piece of bone.
The defendant is accused of negligently selling boneless chicken that contained bones or other foreign objects, failing to adequately warn the food may contain bones, negligent advertising and deceptive naming, failing to properly inspect its boneless chicken and failing to properly and adequately inspect and insure food advertised and marketed as boneless chicken.
An unspecified amount in damages is sought for pain and suffering, disability, mental anguish, medical expenses and loss of enjoyment of life.

The case has been assigned to Division H Judge Glenn B. Ansardi.
