Grandson sues deceased grandfather’s wife for half of estate

GRETNA – A Jefferson Parish man is suing the wife of his late grandfather for half of his estate.

James S. Benz filed suit against Beverly Devries Benz in the 24th Judicial District Court on Sept. 15.

James claims upon the death of his grandfather James Lee Benz in Illinois on Oct. 21, 2010 the estate was to be split by any of his living descendants and his spouse at the time. The plaintiff alleges that he did not receive his half of the estate upon the death of his grandfather.

The defendant is accused of improperly possessing and using assets of the estate.

An unspecified amount in damages is sought for one half of the net assets of the estate of James Lee Benz.

James is represented by attorney Anthony L. Marinaro of New Orleans.

The case has been assigned to Division P Judge Lee V. Faulkner Jr.

Case no. 731-092.
