Sheraton sued after guest falls in slippery bathroom

NEW ORLEANS – A woman who slipped and fell in the bathroom of her Sheraton New Orleans hotel room alleges that there was a leak in the bathroom that caused her fall.

Edna Dukes filed suit against Starwood Hotels & Resorts Worldwind Inc. and Sheraton New Orleans Hotel in the Orleans Parish Civil District Court on Aug. 20.

On Aug. 23, 2012, while Dukes was staying at Sheraton New Orleans, a leak in the bathroom caused the floor to become wet and slippery, according to the complaint. The plaintiff allegedly slipped and fell on the wet floor and suffered a contusion, a wrist spasm and a head injury.

The defendants are accused of failing to properly maintain and service the bathroom fixtures at issue, failing to inspect, failing to warn, creating unreasonable risk of harm for guests and being otherwise negligent.

The plaintiff seeks an unspecified amount in damages for pain and suffering, medical expenses, disability, and lost wages.

The plaintiff is represented by John H. Denena Jr. and Brian G. Shearman of Shearman–Denena LLC of New Orleans.

The case has been assigned to Division F Judge Christopher J. Bruno.
