GRETNA – A company that tattoos permanent makeup onto its customers as well as provides tattoo removal and other services is suing a contractor who performed procedures for them claiming she diverted $25,000 in funds by setting up a competing company.

Softouch Laser Technologies LLC, Softouch Permanent Makeup LLC and Carole Dezarn filed suit against Marian “Mimi” Fallo, Mimi’s Laser Alternatives LLC, Jessica Marasco and Laron Ruiz in the 24th Judicial District Court on Sept. 20.

Softouch Permanent Makeup claims that their business was started on Jan. 4, 2010 by Dezarn and specializes in the permanent application of makeup tattoos and other associated services and Softouch Laser Technologies was started on Nov. 9, 2011 as an accompanying business specializing in the laser removal of tattoos and other services. Fallo was an independent contractor with Softouch Laser Technologies and received a portion of the proceeds from all procedures plus tips, however, she is alleged to have diverted $25,000 from Softouch to herself by setting up Mimi’s Laser Alternatives and taking clientele away from them.

Dezarn asserts she got into an argument with Fallo that ended with Fallo striking her that resulted in bodily in jury and that the defendant borrowed a hot tub from her, sold it and refused to provide any proceeds from the sale.

The defendant is accused of stealing confidential client information, using stolen client information to solicit clients, producing false internet reports through social media networks, misrepresenting ownership of Softouch and other allegedly illegal acts.

An unspecified amount in damages is sought for loss of business, loss of income, mental insult, shock, anguish, loss of enjoyment of life, monies that were diverted and impairment of earning capacity.

Softouch and Dezarn are represented by attorney Paolo J. Messina of Baton Rouge.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
