Company that sold tanning salon suing purchasers for alleged non-payment

GRETNA – An investment company that created a tanning salon business and sold it to a franchisee is suing after the company that purchased the salon allegedly failed to pay monthly installments.

Blake & Blake Investments LLC filed suit against MMS Investments LLC, Jeff Deano and Mandi Deano in the 24th Judicial District Court on Sept. 25.

Blake & Blake Investments claims it entered into a sales and lease agreement with MMS Investments and the Deanos over the purchase of the Planet Beach Contempo Spa located at 1800C East Judge Perez Drive in Chalmette. The plaintiff alleges that the agreement was made on July 1, 2011 for the defendants to pay $95,000 for the business, including $30,000 in cash and $1,256.63 in monthly installments for 30 months in addition to franchise fees. Blake & Blake Investments asserts that beginning in August 2013 the defendants failed to make payments for the business that is currently closed. In addition, the plaintiffs allege that equipment, furniture, fixtures and other movables have been removed from the premises and sold.

The defendant is accused of breach of contract.

An unspecified amount in damages is sought for all amounts dues, attorney’s fees and interest.

The case has been assigned to Division L Judge Donald A. Rowan Jr.
