NEW ORLEANS – A New Orleans man filed suit against The Strip Shop after he was suddenly struck by a falling item while shopping.
Don Roberson filed suit against The Strip Shop Inc. in the Orleans Parish Civil District Court on August 28.
The suit states that on Feb. 22, 2013, the plaintiff was a customer in The Bank Architectural Antiques on Felicity St. in New Orleans, when suddenly and without warning an item fell off the wall and struck him.
The defendant is accused of failing to keep a proper lookout, failing to maintain its premises in a safe and hazard-free condition, failing to secure merchandise, failing to keep its aisles and passageways free from hazards, acting with indifference toward the safety of others, failing to properly train and instruct its employees, and being otherwise negligent.
The plaintiff seeks $50,000 in damages for injuries to his left shoulder, upper arm, head, neck and back, as well as mental anguish, physical pain and suffering, medical expenses and lost wages.
The plaintiff is represented by Joseph M. Bruno Jr. of Bruno & Bruno in New Orleans.
The case has been assigned to Division M Judge Paulette R. Irons.
