Woman sues hotel after bedframe allegedly causes fall

NEW ORLEANS – A woman has filed suit against Canal Lodging claiming she tripped and fell in a hotel room.

Phyllis Poche filed suit against GSMS 2005-GG4 Canal Lodging, LLC, HMC Hospitality Management Corporation and Liberty Mutual Insurance Co.

The suit states the alleged incident occurred on Sept. 22, 2012. Poche claims the cause was a defect in the bed framing.

As a result of the trip and fall, the plaintiff allegedly injured her head, shoulders, back, knees and most severely her elbow.

The defendant is accused of failing to warn, failing to maintain its property in a safe manner, failing to train its employees on safety hazards and being otherwise negligent.

The plaintiff seeks an unspecified amount in damages for medical expenses, physical pain and suffering, mental and emotional pain and suffering, aggravation, inconveniences and loss of enjoyment of life, partial permanent and functional/anatomical disability, future surgical intervention and any other damages.

The plaintiff is represented by Keith Couture of Couture Law LLC in New Orleans.

The case has been assigned to Division M Judge Paulette R. Irons.

Case no. 2013-08972.
