Winn-Dixie sued by woman who claims she was injured after nearly falling when slipping on a floor defect

GRETNA – A local grocery store is being sued by a customer who alleges she was injured after slipping on a defect in its floor.

Brenda Wiltz Irvin filed suit against Winn-Dixie Montgomery LLC and Darren Scioneaux in the 24th Judicial District Court on Nov. 7.

Irvin alleges that she was shopping at the Winn-Dixie located at 4627 Westbank Expressway in Marrero when she stepped on a loose plate or pipe on the floor and slipped. The plaintiff asserts that when she went to catch herself from falling she injured her foot and back. Irvin claims that the piece she stepped on was broken because it gave way when she stepped on it.

The defendant is accused of failing to maintain a reasonable safe area, failing to provide immediate assistance to plaintiff, failing to train employees, failing to warn patrons, reckless endangerment, reckless indifference and failing to properly document and preserve evidence.

An unspecified amount in damages is sought for loss of enjoyment of life, physical disability, pain and suffering, mental pain and suffering, disruption of bodily tissues and cells, medical expenses, disability and exacerbation of prior injuries.

Irvin is represented by Jeffrey P. Green of Harvey-based Austin & Associates LLC.

The case has been assigned to Division D Judge Scott U. Schlegel.
