GRETNA – A man who had implants in his toes that were later broken is suing a number of different medical providers and the implant manufacturer for his injuries.
Kale Flagg filed suit against Dr. Denise Elliott, West Jefferson Medical Center, Foot and Ankle Center, Stryker Corporation, Memomental Inc. USA and their insurers in the 24th Judicial District Court on Dec. 9.
Flagg alleges that on Dec. 10, 2012 while visiting Dr. Denise Elliott and the Foot and Ankle Center it was found that implants that had been previously placed in his toes were broken. The plaintiff claims that due to the breaks he had to undergo two more operations on his toes. Flagg asserts the implants were defectively produced by Stryker Corporation and that a delay in diagnosis of the problem by Elliott led to further injury.
The defendant is accused of selling an unreasonably dangerous product, selling an unreasonably dangerous designed product and failing to provide adequate warning.
An unspecified amount in damages is sought for medical expenses, lost wages, personal injury, disfigurement, inability to walk properly, constant pan, mental anguish and emotional distress.

The case has been assigned to Division P Judge Lee V. Faulkner Jr.
