Dillard’s sued by customer who claims she was injured after slipping on a sign

GRETNA – A customer of a local department store is suing for injuries she claims to have received in a slip and fall on a sign that was on the floor.

Tessa Arcenaux filed suit against Dillard Department Stores Inc., Dillard Department Store #760 and its unknown manager in the 24th Judicial District Court on Dec. 17.

Arcenaux asserts she was shopping at the Dillard’s at Lakeside Shopping Center in Metairie when she stepped on a sign that was laying flat on the floor and fell. The plaintiff alleges the incident resulted in serious personal injuries. Arcenaux claims that because there was no warning about the danger the defendant is responsible for her injuries.

The defendant is accused of negligence, having knowledge of the hazard, failing to repair the hazard and not having safety precautions in place.

An unspecified amount in damages is sought for medical expenses, pain and suffering, emotional distress, mental anguish, permanent disability, disfigurement, loss of earnings and loss earning capacity.

Arcenaux is represented by attorney Barry J. Landry of LaPlace.

The case has been assigned to Division I Judge Nancy A. Miller.
