GRETNA – A truck driver is being sued by a telecommunications after he allegedly damaged their overhead cables when driving on a street where trucks were not permitted.
Bellsouth Telecommunications LLC and AT&T Louisiana filed suit against David L. Peters in the 24th Judicial District Court on Jan. 16.
Bellsouth Telecommunications LLC and AT&T Louisiana allege that on Feb. 12, 2013 Peters made a turn onto a street where truck traffic was not permitted. The plaintiffs assert that the truck damaged a utility pole and overhead cables they own by running into them. Bellsouth Telecommunications LLC and AT&T Louisiana claims that the damage resulted in a interruption of communications of their customers.
The defendant is accused of failing to see what should have been seen, failing to observe what should have been seen, operating without utilizing proper precautions, operating the truck at an excessive rate of speed, operating the truck in an area not designated for truck traffic, failing to comply with applicable permits and violation of state law.
An unspecified amount in damages is sought for repair costs.
The plaintiffs are represented by Michael B. Alker of Mandeville-based Sutton, Alker & Rather LLC.
The case has been assigned to Division K Judge Ellen Shirer Kovach.
