GRETNA – A local homeowner is suing his insurer for its alleged failure to pay for wind damage.
Linh Ngo filed suit against Louisiana Citizens Property Insurance Company in the 24th Judicial District Court on Jan. 31.
Ngo asserts that he entered into a home insurance policy with Louisiana Citizens Property Insurance Company on May 14, 2011 that was to last through May 14, 2012. The plaintiff alleges that while the policy was in effect in February 2012 certain improvements to the property were damaged by strong winds. Ngo claims that on Sept. 26, 2012 a detailed inspection report was forwarded to Louisiana Citizens Property Insurance Company.
According to the plaintiff, Gulf Coast Adjusting estimated the costs of repairs to the home at $34,608.18. Ngo alleges that Louisiana Citizens Property Insurance Company later denied that the damages were due to high winds. The plaintiff claims that while he is awaiting a payment to make the repairs he has been deprived of use of his home and that is continues to deteriorate.
The defendant is accused of breach of contract.
An unspecified amount in damages is sought for payment of the insurance claim, penalties and attorney’s fees.
Ngo is represented by attorney Bradley Egenberg of New Orleans.
The case has been assigned to Division M Judge Henry G. Sullivan Jr.
