GRETNA – A local property owner is suing its insurer for not providing a proper settlement related to Hurricane Isaac damage.
3500 Management LLC filed suit against Great Lakes Reinsurance (UK) PLC in the 24th Judicial District Court on Feb. 1.
3500 Management alleges that its property located at 3500 Jefferson Highway in Jefferson was damaged after Hurricane Isaac made landfall on Aug. 29, 2012. The plaintiff claims that the storm’s winds and rain caused massive damage. 3500 Management asserts that it provided proof of loss, but was denied a full claim.
The defendant is accused of failing to pay all damages, failing to include all damages in scope of loss and damage estimate, failing to bring on qualified professionals to timely and properly assess damages, refusing to pay for matching items, overly depreciating value of property, refusing to explain or provide insured with a copy of depreciation schedule. Failing to pay for post-catastrophic price increases, failing to timely and properly communicate with insured, failing to fully pay all lost rents and failing to initiate loss adjustment and pay in good faith.
An unspecified amount in damages is sought for full value of property damage, loss of use of property, recoverable depreciation, mold damage and remediation, debris clean up, cost of compliance, mental anguish, loss of business income, attorney’s fees, case costs, lost rents and contents, food spoilage and loss of merchandise.
