GRETNA – A local contractor is suing over a contract to renovate a restaurant in which they claim they were not paid for their work.
Eagle-Pro Interior/Exterior Specialists LLC filed suit against J. Williams by Markrois LLC, Markrois Williams and Esplanade Mall Limited Partnership in the 24th Judicial District Court on Feb. 19.
Eagle-Pro alleges they were contracted by Williams to provide renovations on a commercial rental located in the Esplanade Mall located at 1401 W. Esplanade in Kenner that was to be turned into a restaurant called The Bistro. The plaintiff asserts that the renovation proposal of $16,196 was adjustable according to change orders and modifications and open to further expenses.
Eagle-Pro claims that due to extra work requested by Williams in his weekly visits to the job site the contract ended up costing $160,131.03 more than originally budgeted for a total of $176,327.03.
The plaintiff alleges that part of the added expense was due to their procurement of seven televisions and a security system they purchased and mounted on behalf of the defendant. Eagle-Pro asserts they are still owed $38,979 on the contract and they have placed a lien on the property to recover those funds.
The defendant is accused of private works act, breach of contract, liability under open account and unjust enrichment.
Damages in the amount of $38,979 plus legal costs and attorney’s fees are sought by the plaintiff.
The plaintiff is represented by Carolyn S. Buckley of New Orleans-based King, Krebs & Jurgens PLLC.
The case has been assigned to Division O Judge Ross P. LaDart.
