Condo owner sued for not paying fees to condominium association for nearly six years

GRETNA – The owner of a condominium is being sued by her condo association for allegedly not paying fees for her unit in a timely manner.

Chardonnay Village Condominium Association Inc. filed suit against Shirley S. Bonck in the 24th Judicial District Court on Feb. 21.

Chardonnay Village Condominium Association asserts that Binck is the registered owner of condo unit No. 7-A in their building and has run afoul of the community’s bylaws by not paying her condominium association fees in a timely manner. The plaintiff claims the defendant failed to pay condo fees between July 2007 and January 2013 which with a $25 late fee per month amounts to $25,850.61.

Chardonnay Village Condominium Association alleges  they sent demand letter for the outstanding funds to Bonck on Feb. 24, 2013, but she has failed to remit any payment since.

The defendant is accused of breach of contract.

Damages in the amount of $25,850.61, plus legal costs and attorney’s fees are sought by the plaintiff.

Chardonnay Village Condominium Association is represented by Gerard O. Salassi of New Orleans-based Butler Mordock PLC.

The case has been assigned to Division J Judge Stephen C. Grefer.

Case no. 735-782.
