GRETNA – A door manufacturer is suing their property insurance provider for allegedly breaching their contract by refusing to pay for a $696,000 roof they claim was seriously damaged in a hail storm.
Jefferson Door Company LLC filed suit against Mt. Hawley Insurance Company in the 24th Judicial District Court on Feb. 24.
Jefferson Door alleges that they purchased property insurance from Mt. Hawley Insurance to cover hail and wind damage in the amount of $3.3 million for their property, including their metal roof and covered property.
The plaintiff asserts that on Feb. 24, 2013, a hail storm hit Jefferson Parish and damaged their roof, roof trim and seams, exterior siding and caused water damage to the property.
Jefferson Door claims that adjusters Mt. Hawley Insurance sent to assess the damage at the facility erroneously found much of the damage was cosmetic and could be easily fixed and that the damage was only $10,433.83 and did not include replacement of the roof.
The plaintiff claims the defendant should liable for the replacement of their roof at a cost of $696,000.
Jefferson Door Company alleges that despite a disposition by their owner referring to the state of the building’s roof before and after the storm Mt. Hawley Insurance has refused to replace the roof.
The defendant is accused of breach of contract and extra contractual liability.
An unspecified amount in damages is sought for the amount it costs to repair heir property plus a penalty two times the amount of the repair.
Jefferson Door Company LLC is represented by Patrick S. McGoey of New Orleans-based Schonekas, Evans, McGoey & McEachin LLC.
The case has been assigned to Division G Judge Robert A. Pitre Jr.
