GRETNA – A local furniture company is suing its property insurance provider for allegedly failing to properly cover damages received during a hail storm.
St. Germain Furniture Company Inc. filed suit against Louisiana Citizens Property Insurance Corporation in the 24th Judicial District Court on Feb. 24.
St. Germain Furniture Company Inc. claims it contracted with Louisiana Citizens Property Insurance Corporation for their property insurance beginning on Feb. 24, 2013 and that the policy was in effect when a hail storm hit their building located at 2432 Belle CHasse Highway in Gretna. The plaintiff alleges the defendant sent adjusters to their property for a damage estimate following the storm and that the subsequent payments made for the damage were insufficient. St. Germain Furniture Company Inc. asserts that Louisiana Citizens Property Insurance Corporation misrepresented the insurance policy they provided and it underpriced the damages and did not timely pay for those damages.
The defendant is accused of breach of contract and bad faith claims adjusting practices.
An unspecified amount in damages is sought for uncompensated property damage, loss of rental income, diminution of property value, repair and remediation expenses, penalties for violating state law and attorney’s fees.
St. Germain Furniture Company Inc. is represented by David A. Binegar of New Orleans-based Binegar Christian LLC.
The case has been assigned to Division M Judge Henry G. Sullivan Jr.
