GRETNA – A local plaintiff’s attorney and his wife are suing their property insurance company for allegedly not covering damages to their home stemming from a hail storm.
Blaine M. and Toni M. Hebert filed suit against ANPAC Louisiana Insurance Company in the 24th Judicial District Court on Feb. 24.
The Heberts allege that their home located at 6 Wedgwood Court in Harvey was damaged on Feb. 24, 2013 during a storm that caused damage to the proper from rain and hail. At the time the plaintiffs claim they had a full policy with ANPAC Louisiana Insurance Company in effect. The Heberts assert that their home received damages to its roof, drip edges, ridge line, vent pipe, gutters, downspouts, window screens, stucco, exterior gas lights, air conditioning fins, window re-glazing, furnace vent cap and chimney rain cap.
The plaintiffs say that the defendant failed to properly adjust the claim on their home and underpaid for the needed repairs.
The defendant is accused of failing to fulfill its duties of good faith and fair dealing and failing to make prompt and reasonable efforts to settle claims under state law.
An unspecified amount in damages is sought for all costs, expert fees, court costs, legal interest, statutory penalties and attorney’s fees.
