Family of woman who died weeks after car accident sues for wrongful death

GRETNA – The family of a woman who died after being involved in a car accident is suing.

Darryl Anderson and Trenton Dabney, and succession of Tracey Chandler Anderson, filed suit against Alfonso Chen and State Farm Mutual Automobile Insurance Company in the 24th Judicial District Court on Feb. 24.

Anderson and Dabney claim their mother Tracey Chandler Anderson was involved in a car accident in which Chen ran his vehicle in the rear of her car on March 27, 2013. The plaintiffs allege Anderson was injured in the accident when the impact caused her to be jolted back and forth that resulted in injuries to her back and chest and caused her blood pressure to rise. Anderson and Dabney assert that her injuries in part resulted in her death nearly two months later on May 23, 2013.

The defendant is accused of failing to keep a proper lookout, failing to see what should have been seen, failing to keep vehicle under control, operating vehicle in an unsafe manner, failing to sound warning of his approach, failing to stop the vehicle in sufficient time, operating the vehicle too closely, driving at excessive speeds, being inattentive, using inadequate defensive driving techniques, failing to stop vehicle behind traffic, tailgating, disregarding traffic and making incorrect assumptions about other drivers.

An unspecified amount in damages is sought for mental anguish, conscious pain and suffering, pain and suffering prior to death, loss of enjoyment of life, fear of death and wrongful death.

Anderson and Dabney are represented by attorney Ford T. Hardy of New Orleans.

The case has been assigned to Division B Judge Cornelius E. Regan.
