Man sues for same injuries in two car accidents that occurred within two weeks

GRETNA – A man who claims he received the exact same injuries in two car accidents that occurred within two weeks is suing both drivers.

Ervin Johnson filed lawsuits against Howard Weiser and Allstate Insurance Company and Timothy Joseph and Louisiana Farm Bureau Insurance Company in the 24th Judicial District Court on Feb. 26.

In both lawsuits Johnson claims he was driving his 2000 Ford Crown Victoria when he was struck by other vehicles.

First, Johnson alleges on March 17, 2013 he was driving down Cook Street in Gretna when Weiser backed into the front of his vehicle when attempting to park. The plaintiff alleges he received injuries in the accident to his back, hip, knees and numerous other parts of his body.

Weiser is accused of failing to use reasonable vigilance, recklessness, inattention and violating the rules of the road.

In the second incident Johnson alleges he was driving on Monroe St. in Gretna on April 3  when a vehicle being driven by Joseph ran a stop sign and ran into his car. The plaintiff claims that he received the exact same injuries in that accident with Johnson as what he had received only weeks earlier in the accident with Weiser.

Joseph is accused of disregarding a stop sign, failing to maintain proper control, operating his vehicle in a reckless and careless manner, failing to use reasonable vigilance, recklessness, inattention and violating the rules of the road.

In both cases damages not to exceed $50,000 are sought for medicine, drugs, hospitalization, medical care, pain and suffering, residual disabilities, mental anguish, emotional upset and distress, loss of enjoyment of life and psychological sequelae.

Johnson is represented by in both cases by attorney Patrick G. Kehoe Jr. of New Orleans.

Case no. 735-914, against Weiser, has been assigned to Division G Judge Robert A. Pitre Jr.

Case no. 735-913, against Joseph, has been assigned to Division N Judge Stephen D. Enright Jr.
