GRETNA – A woman is suing a local flooring store after she was allegedly injured when a bench collapsed beneath her.
Schirelle M. Wiltz filed suit against Floor & Decor Outlets of America, Continental Casualty Company, an unknown manufacturer and their insurers in the 24th Judicial District Court on Feb. 26.
Wiltz alleges she was a customer at the Floor & Decor Outlets of America located at 4 Westside Shopping Center in Jefferson when she sat on a bench outside the store and it collapsed, broke into several pieces and she fell to the ground. The plaintiff asserts that she was severely injured in the incident that has since required ongoing medical treatment.
The defendant is accused of failing to warn the bench was defective, failing to safeguard the premises, failing to warn business invitees of the weight capacity of the bench, failing to discover the condition of the bench and remove it, failing to inspect the premises for a dangerous condition, failing to warn customers and failing to properly test the bench to determine it was safe.
An unspecified amount in damages is sought for mental anguish, aggravation, annoyance, disability, physical pain and suffering, mental anguish, medical expenses, lost wages, loss of enjoyment of life, loss of use of function of parts of the body, bodily disability, impairment of psychological functioning, disability, destruction of earning capacity and disability from engaging in recreation.
