Casino sued by woman who claims her head was cut open in fall

GRETNA – A local casino is being sued by a patron who claims she was severely injured and had to get staples to close a cut in her scalps she received after tripping and falling over a piece of bunched up carpet.

Nancy Flournoy, and husband David, filed suit against Treasure Chest Casino LLC in the 24th Judicial District Court on Feb. 28.

Flournoy asserts that on Oct. 11, 2013 she was at the Treasure Chest Casino located at 5050 Williams Blvd. in Kenner when she was attempting to exit the premises and tripped over a carpet that was bunched up and hit her head against a door frame as she was falling. The plaintiff alleges that a witness made a statement  confirming the events leading up to the fall. Flournoy claims she received lacerations to her scalp that needed to be stapled shut as well as other injuries to her back, neck, head trauma and neurological damage.

The defendant is accused of failing to maintain the safety of the property, failing to take all precautions to avoid the incident, failing to discover and correct the condition, failing to provide a safe pathway, unsafe practices, failing to properly position the carpet, failing to furnish crew for purposes of maintaining the safety of the premises and failing to provide notice of the hazard.

An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering, emotional pain, loss of enjoyment of life, medical expenses, loss of wages, impairment of earning capacity and disability.

Flournoy is represented by attorney Douglas M. Schmidt of New Orleans.

The case has been assigned to Division C Judge June Berry Darensburg.
