GRETNA – A commercial landlord is being sued by a customer who claims he broke both of his hands in a parking lot fall.
Isaac Hallak filed suit against Steve Ciolino in the 24th Judicial District Court on March 11.
Hallak asserts that on March 11, 2013 he was exiting a CVS Pharmacy located at 4650 West Esplanade in Metairie, the premises of which are co-owned by Ciolino. He claims he tripped in the parking lot and fell to the ground. The plaintiff alleges that he broke both of his hands in the fall and the injuries have required extensive treatment to recover.
The defendant is accused of failing to keep the premises in a reasonably safe condition, failing to use reasonable effort in keeping the premises free of hazards, failing to prevent customers from suffering harm, failing to warn of the dangerous condition, failing to inspect the property, failing to provide a safe environment, failing to warn of unreasonable risks, failing to implement proper procedures, failing to provide a hazard-free environment, failing to remedy unreasonably dangerous hazards and failing to comply with applicable building codes.
An unspecified amount in damages is sought for physical pain and suffering, mental anguish, discomfort, medical expenses, lost wages, lost wages, property damage, loss of enjoyment of life, disability from working, destruction of earning capacity and disability from engaging in recreation.
