Man who claims truck backed up and pinned him to dumpster sues

GRETNA – A man who claims he was injured when a trucked backed up into him, pinning him to a dumpster, is suing.

John Swafford filed suit against Progressive Security Insurance Company, Ryan Mabile and Mabile Seafood Inc. in the 24th Judicial District Court on March 25.

Swafford asserts that on March 28, 2013 he was breaking down boxes in the parking lot of Harry’s Dive Shop at 4709 Airline Drive in Metairie when Mabile backed a truck owned by Mabile Seafood into him and pinned him to the dumpster. The plaintiff alleges he was seriously injured in the incident.

The defendant is accused of failing to see what should have been seen, failing to yield to a pedestrian, failing to ensure the path was clear when backing up and failing to maintain proper lookout.

An unspecified amount in damages is sought for medical expenses, lost wages, loss of earning capacity, mental pain and suffering and physical pain and suffering.

Swafford is represented by J. Van Robichaux Jr. of New Orleans-based Robichaux Law Firm LLC.

The case has been assigned to Division C Judge June Berry Darensburg.
