NEW ORLEANS – A sub-contractor is suing over a pay dispute on work done at an elementary school.
S&L Steel Erectors Inc. filed suit against Quality Iron Fabricators Inc., MAPP Construction LLC and Travelers Casualty and Surety Company of America in Orleans Parish Civil District Court on Jan. 24.
According to the suit, during the project to renovate the Little Woods Elementary School, S&L entered into a sub-contract with Quality for the installation of structural and other miscellaneous steel. The suit claims MAPP acted as the general contractor and Quality contracted as a subcontractor to MAPP. Travelers provided the statutory performance and payment bond to MAPP, the suit claims.
S&L claims its original sub-subcontract with Quality was for $522,000. During the course of the project, S&L alleges contract adjustments increased the price of the sub-subcontract to $624,455.42. The suit alleges that Quality has partially paid S&L, leaving an unpaid balance of $145,320. As MAPP and Quality have been paid for work performed, S&L alleges all the defendants are indebted in solido to S&L Steel in the full sum of $145,320 together with penalties, interest, court costs, and attorney’s fees.

MAPP Construction, LLC and Travelers Casualty and Surety Company of America answered and cross claimed against Quality on Feb. 28. Due to the subcontract between MAPP and Quality, they claim Quality is required to indemnify and defend MAPP and Travelers for any and all claims asserted by S&L. Furthermore, they argue that S&L did not have a contract with MAPP.
